Rising LPA Fees: Why It Pays to Act Now

A Lasting Power of Attorney (LPA) is one of the most important legal documents you can have in place. It allows you to appoint trusted people—your “attorneys”—to make decisions on your behalf if you’re unable to do so yourself due to illness, accident, or loss of capacity.

Recently, however, the Office of the Public Guardian (OPG) announced an increase in the fees to register an LPA. While the rise may appear small, it can quickly add up—especially for couples or anyone setting up both types of LPA (Property & Financial Affairs, and Health & Welfare).

And here’s the key point: to avoid paying the higher fees, your LPA documents must be signed and submitted before 17th November. To be clear any applications received by the OPG from the 17th November onwards will be charged at the new higher rate.

Why are LPA fees rising?

The OPG reviews its fees regularly to reflect the cost of processing applications. With rising administrative expenses, the government has increased the registration fee, meaning it’s now more expensive to set up your LPA than it was just a short time ago.

For individuals and families, this highlights an important point: the longer you wait, the more you may end up paying.

The cost of delaying an LPA

Putting off an LPA doesn’t just risk paying higher fees—it can leave your family in a very difficult position. If you lose capacity without an LPA in place, your loved ones would need to apply to the Court of Protection to manage your affairs. This process is:

  • Far more costly than registering an LPA.

  • Time-consuming, often taking months.

  • Stressful for families already dealing with difficult circumstances.

In short, waiting doesn’t save money—it increases the financial and emotional burden later on.

Why acting early makes sense

  • Secure today’s lower fees by signing and submitting your documents in time.

  • Avoid the increase and save money, especially if arranging more than one LPA.

  • Protect your family’s future with a legally binding plan already in place.

  • Enjoy peace of mind knowing you’ve taken action before the deadline.

Take control of your future today

The cost of LPAs may be rising, but the protection they offer is invaluable. By arranging your LPA now—you can lock in current fees, avoid the increase, and give your family the certainty they deserve. We advise that we start the process before 31st October and all documents must be signed by 10th November to guarantee the lower fees.
